Litigation Includes the Entire Process Leading up to a Trial including any Subsequent Appeals
Litigation is the process where a claim is brought against another individual or legal entity in the public court system. It often includes procedural and/or dispositive motion practice. Discovery is required to further support a client’s interests, uncover the adversary’s position, lock that adversary into a set of facts for trial, and to decide if the case is worth pursuing or settling. If a case cannot be settled, the case will proceed to trial, where a judge or jury will decide the facts and render a verdict. Furthermore, the completion of a trial is not necessarily the end of litigation. Litigation includes any subsequent appeals and any work required to enforce the verdict rendered at trial.
